Special Education Rights in Nebraska

Nebraska's IEP rule (92 NAC 51-007). The IEP meeting must be held within 30 CALENDAR DAYS of the determination that the child needs special education (§ 51-007.09A). Transition: beginning no later than the first IEP in effect when the child turns 14 — earlier than the federal 16 — updated annually, with the student invited to the meeting. Parental consent (92 NAC 51-009) is required before the initial evaluation, before the initial provision of services, and before any reevaluation — not for each annual IEP.

What this means for you: The IEP meeting happens within 30 calendar days of the eligibility determination (92 NAC 51-007.09A). Transition planning starts by the first IEP in effect when your child turns 14 — earlier than the federal 16 (§ 51-007.07A9) — and your child is invited to the meeting. Your consent is required before the initial evaluation, before services first start, and before any reevaluation (92 NAC 51-009). PTI Nebraska is the state parent training center.

Nebraska special-education entitlement statute. Provides FAPE for children with disabilities birth through age 21. Nebraska is one of few states explicitly providing services from BIRTH through the public school system (alongside the Part C early intervention system).
